A pesquisa visa realizar análise jurídica sob a perspectiva histórica da demarcação do território Xavante, buscando compreender os fatores que envolvem a preservação das manifestações culturais dos povos originários, vez que a proteção dos direitos indígenas, garantidos pela Constituição Federal de 1988, reconhece a urgente necessidade de promover e respeitar os direitos e características dos povos indígenas, que se originam em sua história, filosofia, culturas, tradições espirituais e outras, assim como em suas estruturas políticas, econômicas e sociais, especialmente em relação aos bens culturais. Quanto ao método será o comparativo para averiguar as tradições, rituais e festas sob uma perspectiva intercultural, por intermédio da pesquisa documental e bibliográfica a fim de realizar o levantamento dos livros, dissertações, teses, artigos, legislações e notícias que aborde a temática, possibilitando ao pesquisador, a partir da discussão com diferentes textos e posicionamentos, a consolidação do seu referencial teórico-metodológico.
This research aims to conduct a legal analysis from a historical perspective of the demarcation of Xavante territory, seeking to understand the factors involved in the preservation of the cultural expressions of Indigenous peoples. The protection of Indigenous rights, as guaranteed by the 1988 Federal Constitution, acknowledges the urgent need to promote and respect the rights and characteristics of Indigenous peoples, which are rooted in their history, philosophy, cultures, spiritual traditions, and other aspects, as well as their political, economic, and social structures, particularly in relation to cultural assets. The method will be comparative, examining traditions, rituals, and festivals from an intercultural perspective, through documentary and bibliographic research to collect books, dissertations, theses, articles, legislation, and news on the topic. This approach will allow the researcher to consolidate their theoretical-ethodological framework through discussion with different texts and viewpoints.
